Â
4. Payment Responsibility
Â
Unless otherwise agreed, payment must be made by the instructing party or a third party acting on their behalf.
Â
Pearman Social Work Consultancy will not ordinarily accept payment directly from the person being assessed.
Â
This approach is intended to avoid any actual or perceived conflict of interest and to ensure that the independence of the assessment is maintained.
Â
Where the assessment relates to financial decision-making, property and affairs, or the person's capacity to manage their finances, accepting payment directly from the individual may be inappropriate, as their capacity to consent to the expenditure itself may form part of the assessment.
Â
Any exceptions to this arrangement will be considered on a case-by-case basis.
Â
5. Professional Independence
Â
All assessments are conducted independently and in accordance with the Mental Capacity Act 2005, relevant legislation and professional standards.
Â
Payment of fees does not influence the outcome of any assessment.
Â
The outcome of an assessment will be based solely on the evidence available, the individual's presentation during the assessment and the professional judgement of the assessor.
Â
Pearman Social Work Consultancy cannot guarantee any particular outcome, finding or recommendation.
Â
6. Mileage & Travel Costs
Â
Mileage charges apply to face-to-face appointments and are calculated at £0.55 per mile from Hockley, Essex.
Â
Travel costs will be discussed, agreed and added to the total fee before the appointment is confirmed.
Â
No additional mileage charges will be applied after agreement unless expressly agreed in advance.
Â
7. Cancellations & Rearrangements
Â
If an appointment needs to be cancelled or rearranged, at least 24 hours' notice must be provided.
Â
One appointment rearrangement may be offered without additional charge.

Â
Pearman Social Work Consultancy reserves the right to waive cancellation fees in exceptional circumstances at its discretion.
Â

Â
Any technical difficulties should be reported as soon as possible so that reasonable adjustments can be considered.
Â
9. Court of Protection (COP3) Assessments
Â
The agreed COP3 fee covers:
Â
-
Review of relevant information provided
-
Completion of the assessment
-
Completion of the COP3 form
Â
The full COP3 fee remains payable regardless of the outcome of the assessment, including where the individual is assessed as having capacity.
Â
The assessment fee relates to the professional assessment undertaken and completion of the required documentation, rather than a particular outcome.
Â
Where an individual is assessed as having mental capacity following a COP3 assessment and wishes to make a Lasting Power of Attorney (LPA), Pearman Social Work Consultancy may complete the Certificate Provider section of the LPA where requested and appropriate. No additional fee will be charged for this service.
Â
10. Lasting Power of Attorney (LPA) Certificate Provider Services
Â
The agreed LPA fee includes:
Â
-
Review of relevant information
-
Capacity assessment
-
Completion of the Certificate Provider section of the LPA where appropriate
Â
Completion of the Certificate Provider section will only occur where the statutory requirements are met and the individual is assessed as having the capacity to make the LPA and is acting voluntarily.
Â
Where an individual is assessed as lacking capacity to make an LPA and a Court of Protection (COP3) assessment is subsequently requested, the fee already paid for the LPA assessment will be deducted from the standard COP3 fee.
Â
11. Documentation & Timescales

Â
This may include:
